WIN Learning Privacy Policy

Below is the WIN Privacy Policy (the “Policy”). This Policy helps you to make informed decisions about your relationship with us, so please read it carefully.


1. Introduction

Thanks for choosing WIN. To provide you with the WIN services, applications, systems, and websites (collectively, “Services”), WIN Learning (“WIN”, “we”, “us”, or “our”) needs to collect some information about you, and this Policy is where we describe the information we collect, what we do with it, and how you can manage and control the use of your information. By using or interacting with the Services, you are entering into a binding contract with us and consenting to the use of your information as explained in this Policy. If you don’t agree with these terms, then please don’t use the Services.


2. The information we collect

2.1 Registration Data

When you sign up for the Services, we may collect information we ask you for, such as username, password, email address, and full name. We will use industry-standard methods and technology to protect your personally identifiable information. We may store and
use any of this information for the purposes explained in Section 3.


2.2  User Generated Content

While using the Services, you may enter information into a free text field, or from multiple choice or drop-down selections. 


2.3 Web Beacons

Web beacons are small, graphic images on web pages or web-based documents or in email messages. We may use web beacons in   order to personalize your experience with WIN, determine the usefulness of the information our Services provide and analyze general user traffic patterns. 


2.4 Cookies

WIN may use its own cookies and cookies from third parties, to personalize your experience with WIN and to track and analyze your usage of the Services and, more generally, the internet.


2.5 Device Information

WIN may collect your IP address; device information including location and data/time stamp, and other characteristics; and any of your preferences within the Services. 


3. How we use and share the information we collect

We may use the information we collect, including your personally identifiable information provided during the registration process, to: (i) provide, monitor, personalize, and improve your experience with the Services; (ii) ensure technical functioning of the Services, develop new products and services, and for statistical and analytical purposes; (iii) communicate with you for Services-related purposes; (iv) enable and promote the Services; (v) enforce this Policy, the Terms and Conditions of Use, and the Application Terms, including to protect the rights, property or safety of WIN, users or any other person and the copyright-protected content of the Services; and (vi) as otherwise stated in this Policy.


4. AI

When you use WIN's AI enabled features, your personal information may be used to help generate the output. We may also anonymize and/or aggregate your personal information for AI training and development.

WIN will never directly use your personal information to train our AI models, or those provided by our third parties.


5. Security

We are committed to protecting our users’ information. Your password protects your user account, so you should use a unique and strong password, limit access to your computer and browser, and sign off after having used the Services. We use industry-standard methods and technology to protect your information. Though we will take reasonable steps to protect your information, we cannot guarantee the security of your information at any time.


6. Children

We understand the importance of safeguarding personal information related to students under 13, especially when it is part of a school's educational records. This information is protected by federal laws, specifically COPPA and FERPA. Our privacy practices adhere to the requirements of both COPPA and FERPA.


Under COPPA, a school can act as a "parent" to give necessary permissions for handling personal information of students under 13. When a school subscribes to our Services, we depend on this COPPA consent. We share our Privacy Policy with the school to ensure they have all the information needed to confirm our practices align with COPPA.


FERPA allows schools to share educational records, which may include students' personal information, with certain service providers without needing specific parental consent. This is permissible when the service provider functions as a "school official," performing tasks typically done by school employees. We meet FERPA's criteria for being a school official by allowing the school to control the use and maintenance of the educational records, including personal information, and by not re-disclosing or using this information beyond providing our Services. We adhere to FERPA by relying on this consent method.


7. Accessing and updating user information

You can access and amend some of the information we keep on you through your settings. To learn more about the information we store about you, e-mail privacy@winlearning.com. We will respond within a reasonable period of time upon verification of your identity.
